1. INTRODUCTION
These Terms and Conditions (“Terms”) govern the relationship between Kreation Kenya and any person or entity (“you,” “your,” “traveler,” or “participant”) booking or participating in any service we offer, including but not limited to:
- In-person safaris and excursions;
- Virtual tours (live or recorded);
- Any related products or services.
By making a booking or using our services, you confirm that you have read, understood, and agreed to these Terms. If booking for others, you are responsible for ensuring they are aware of and agree to these Terms.
2. SCOPE OF SERVICES
Kreation Kenya organizes and facilitates guided tours, safaris, cultural experiences, and virtual tourism events in Kenya and occasionally beyond. Services may be provided directly or through third-party suppliers (e.g., transport companies, accommodation providers, guides, event platforms).
3. BOOKING PROCESS
3.1 Enquiries & Quotes
Prices and itineraries provided in quotes are subject to change until the booking is confirmed.
3.2 Confirmation
A booking is confirmed when:
- You receive a written confirmation from us, and
- We receive the required deposit or full payment.
3.3 Deposit & Balance
- For safaris: typically 30% deposit, with the balance due 30–45 days before tour start.
- For virtual tours: full payment at booking, unless otherwise agreed.
3.4 Failure to Pay
If payment deadlines are missed, we may treat the booking as cancelled and apply cancellation charges.
4. PRICING & PAYMENT
4.1 Currency
All prices are quoted in United States Dollar (USD) unless otherwise stated.
4.2 Inclusions & Exclusions
Each itinerary specifies what is included (e.g., accommodation, meals, park fees). Any items not listed are at your expense.
4.3 Payment Methods
We accept Paypal payments, bank transfers, and major credit/debit cards via secure payment processors.
4.4 Price Changes
We reserve the right to adjust prices before confirmation due to changes in taxes, park fees, exchange rates, or supplier costs.
5. CANCELLATIONS & REFUNDS
Our Refund & Cancellation Policy forms part of these Terms and applies in full.
You are advised to review that policy before booking.
6. CUSTOMER RESPONSIBILITIES
6.1 Travel Documents
You are responsible for securing valid passports, visas, vaccination certificates, and any other required travel documents.
6.2 Health & Fitness
You must ensure you are fit to participate in the booked activities. Certain tours require moderate physical activity; inform us of any medical conditions or dietary needs at booking.
6.3 Compliance
You must follow local laws, park regulations, and instructions from our guides or representatives.
6.4 Behavior
We reserve the right to remove any participant from a tour, without refund, if their behavior is dangerous, disruptive, or unlawful.
7. VIRTUAL TOURS
7.1 Access Links
We will send access links to the email provided. You are responsible for ensuring you have the necessary device, internet connection, and platform compatibility.
7.2 Recordings
Some sessions may be recorded with prior notice. By participating, you consent to incidental appearance unless you opt out before the tour.
7.3 Sharing & Use
You may not share access links or recordings without our written consent.
8. THIRD-PARTY SUPPLIERS
8.1 Supplier Terms
Our services may involve suppliers (e.g., hotels, airlines, vehicle hire). Their terms apply in addition to ours.
8.2 Liability
We act as an agent for such suppliers and are not liable for their acts, omissions, or failures, except where required by Kenyan law.
9. CHANGES BY US
We may alter itineraries due to weather, safety concerns, park closures, or operational reasons. We will offer alternatives where possible. If no alternative is acceptable, you may receive a refund per our Refund Policy.
10. FORCE MAJEURE
We are not liable for delays or cancellations caused by events beyond our reasonable control, including natural disasters, epidemics, political unrest, strikes, or government actions.
11. LIABILITY & DISCLAIMERS
11.1 Assumption of Risk
Participation in safaris and related activities involves inherent risks (e.g., wildlife encounters, road travel). You accept these risks.
11.2 Limitation of Liability
To the maximum extent permitted by Kenyan law, our liability is limited to the amount you paid for the service in question.
11.3 No Guarantee of Sightings
Wildlife sightings cannot be guaranteed.
12. INSURANCE
We strongly recommend you obtain comprehensive travel insurance covering medical emergencies, trip cancellation, loss of belongings, and personal liability.
13. INTELLECTUAL PROPERTY
All content, photos, videos, and materials produced by Kreation Kenya remain our property unless otherwise stated. You may not use them commercially without written permission.
14. PRIVACY
We collect and process your personal data in line with our Privacy Policy. By booking, you consent to such processing.
15. GOVERNING LAW & JURISDICTION
These Terms are governed by the laws of Kenya. Any disputes will be resolved in Kenyan courts, unless otherwise agreed in writing.
16. AMENDMENTS
We may update these Terms at any time. Changes will be posted on our website and will apply to bookings made after the date of publication.
